Many Americans assume that succession in Italy works like probate in the United States. It does not. And that misunderstanding often creates unnecessary fear.

How Probate Works in the United States
In the U.S., inheritance rules are state-based rather than federal. This means probate can vary substantially depending on where you live. In general, when someone passes away, their estate may go through probate court, a process that can be lengthy, bureaucratic, expensive, public, and emotionally draining for families.
Attorney fees, court costs, executor fees, and delays are common. In some states, legal costs can account for several percentage points of the estate value, and timelines can extend for months or even years. That said, probate is not always unavoidable.
